What these terms cover
Only the use of this website. By opening and reading it you agree to what follows. If you do not, the simplest remedy is not to use it.
An actual project (a website built for your business) is not contracted from here. It has its own agreement, with scope, price, deadlines and ownership set out in writing. Nothing on this page replaces that, and nothing on this page by itself creates a contractual relationship between us.
How the site may be used
You may read it, pass it on, screenshot it and quote what is written here with attribution. That is what it is for.
What you may not do:
- attempt to gain unauthorised access to the site, its hosting or any related system;
- try to transmit harmful code, files or content through the form;
- scrape the content at a volume that affects how the site works for everyone else;
- reproduce the design, text or code in order to build a competing service;
- use the name or mark "The Site Factory" in a way that suggests an association that does not exist.
Intellectual property
The design, text, structure and code of this site are mine, with the exceptions below. They are protected by copyright law and may not be copied wholesale without my written permission.
The portfolio screenshots show websites that belong to my clients. Their content (photographs, text, names, trade marks) remains theirs. It appears here because I built those sites, not because I have any right over what is in them.
The fonts used on this site are licensed from their authors, each under its own licence. They are not mine and are not passed on with anything else.
If you believe something here infringes a right of yours, write to me and I will look into it. You do not need a lawyer for the first message.
The information on this site
I write everything carefully and verify the figures I publish. The performance measurements in the case studies are real, taken under the conditions described on the page in question, and may look different on another device, another connection or another day.
The prices shown are starting prices, marked "from". They are indicative and do not constitute a binding offer. The real price of a project depends on what has to be built and is agreed in writing before any work begins.
The delivery time mentioned on the site describes projects the size of those in the portfolio, with materials supplied on time. It is not a contractual guarantee in itself; the deadline that counts is the one in your project agreement.
Links to other sites
The site links to client websites and to a few external resources. Once you have left, you are on someone else's territory: I do not control what those pages contain, how they change over time, or what data they collect.
A link does not mean I endorse what is at the other end. For client sites it means only that I built them.
Availability
The site is statically hosted and built to stay up. Even so, I do not guarantee uninterrupted availability: hosting, the domain or the network can have problems outside my control, and from time to time I publish changes.
I may change, move or remove any part of the site without prior notice.
Limitation of liability
The site is provided as a source of information. I am not liable for losses arising from using it, for example business decisions taken solely on the basis of what you read here, or being unable to reach it at a given moment.
I do not, and cannot, limit liability for wilful misconduct, gross negligence, personal injury or death, or for anything else Romanian law does not permit to be limited. Nothing in this text restricts the rights the law gives you as a consumer, if you are acting outside your trade or profession.
Complaints and dispute resolution
If you are unhappy about something, write to me first. Most things are settled in one message.
If you are a consumer and we cannot reach a solution, you may contact the Romanian National Authority for Consumer Protection at anpc.ro, including for alternative dispute resolution.
Personal data
How your data is handled is explained separately, in the privacy policy and the cookie policy. Those two documents form part of these terms.
Changes
I may update these terms. The version that applies is the one published here at the time you use the site, and the date of the last update is shown at the top. I do not keep a public version history; if you need an earlier version, ask me for it.
Governing law
These terms are governed by Romanian law. If a dispute arises that cannot be settled otherwise, the courts of Romania have jurisdiction.
If any provision of this text turns out to be invalid, the rest remains in force.
